How to start an IOP or PHP in Tyler

Tyler is the medical hub for a wide piece of East Texas. Smith County sits in a 34-county rural Medicaid service area where no single plan covers both STAR and STAR+PLUS, and the Andrews Center handles both mental health and substance use access for the region. Here's what that means for opening a substance use intensive outpatient or partial hospitalization program, from operators who run a licensed Texas PHP, IOP and outpatient program.

Updated October 27, 2026. Not legal advice. Cima Consulting isn't a law or accounting firm; confirm building rules with the city and plan line-ups with HHSC before you rely on them.

The short answer: a Tyler SUD program needs HHSC's chemical dependency treatment facility license, like any Texas program. The City of Tyler's Unified Development Code requires a certificate of occupancy before a building is occupied or its use changes, requested together with the building permit through Development Services. Smith County is in the Medicaid Rural Service Area (MRSA) Northeast, where HHSC lists Superior and Wellpoint for STAR and the STAR+PLUS plans are Molina and UnitedHealthcare, so covering both adult programs takes four contracts. The Andrews Center is the local mental health authority for Smith and four nearby counties and runs OSAR for HHSC Region 4.

STAR plans from HHSC's managed care service areas map (revised August 2026) and STAR comparison chart; STAR+PLUS from the awards that took effect September 1, 2024, and the plans' 2026 materials; counties from Molina's MRSA Northeast list. Tyler County, near Beaumont, is a different place in a different service area.

The license is statewide

HHSC licenses Texas substance use programs as chemical dependency treatment facilities under Health and Safety Code chapter 464 and 26 TAC 564; Tyler adds no treatment license. As of October 2026 the fee under 26 TAC 564.408 is $1,200 plus $125 per additional site. Programs that grow from Tyler often add Longview or Lufkin; each address is licensed separately and needs its own certificate of occupancy. The packet is in our CDTF license guide, the proof list in 26 TAC 564 in plain English, and the whole path in how to start an IOP or PHP in Texas.

Zoning, permits and the certificate of occupancy

Tyler's rules live in its Unified Development Code, chapter 10. Section 10-5 says:

  • The building official must issue a certificate of occupancy before a building is occupied or a property's use changes.
  • The certificate is requested together with the building permit application and issued once construction is finished and conforms to the code.
  • A sign permit won't be issued without an approved certificate of occupancy, so your exterior sign waits for it.

Moving a counseling program into a former retail or office space is usually a change of use, so plan on a permit application even for a light build-out. Ask Development Services in writing before you sign:

  1. Is an outpatient substance use treatment program allowed in this zoning district under the Unified Development Code?
  2. Is our move-in a change of use, and which permits will it need?
  3. What will the fire inspection check, given our group-room occupant load?
  4. How long are commercial plan reviews running?

Addresses in Whitehouse, Lindale or unincorporated Smith County follow those rules instead. Lease with a contingency for the certificate of occupancy and the HHSC license; every site step is on our Texas IOP opening checklist.

Medicaid plans in MRSA Northeast

After the HHSC license, enroll with TMHP, then credential with each plan. TMHP has said Medicaid SUD treatment may only be delivered in a licensed chemical dependency treatment facility (TMHP notice).

ProgramWho it coversPlans in MRSA Northeast
STARMost children, pregnant women and some familiesSuperior, Wellpoint
STAR+PLUSAdults with disabilities and adults 65 and olderMolina, UnitedHealthcare
  • No plan is in both. That's unusual. In most Texas service areas at least one plan sits in STAR and STAR+PLUS; here an adult program that wants both programs needs four contracts. Decide which matters more for the clients you expect: STAR adults are mainly pregnant women and some parents, while STAR+PLUS covers adults with disabilities and adults 65 and older.
  • STAR+PLUS: Molina and UnitedHealthcare. HHSC's 2024 award lists Molina for Northeast Texas, and UnitedHealthcare's 2026 manual lists MRSA Northeast for STAR+PLUS. Our guides: Molina and UnitedHealthcare and Optum.
  • STAR: Superior and Wellpoint. In the rural areas Wellpoint uses MultiPlan's Texas True Choice network; see the Superior HealthPlan and Wellpoint Texas guides.

The process is in our Texas Medicaid credentialing guide, and every area is in Texas Medicaid health plans by service area. Four applications is exactly the kind of work our credentialing service takes off your plate.

Serving East Texas from Tyler

  • Schedule for the drive. Clients come from Van Zandt, Wood, Henderson and farther. Evening IOP tracks for working clients, and transportation planning at intake, keep attendance up; see our IOP schedule templates.
  • Telehealth within the rule. 26 TAC 564.911 allows counseling by electronic means with identity verification, consent for each service, written risks first, and audio-only only with an existing clinical relationship and a documented reason. Check each plan's coverage before you build a remote track.
  • Medicaid is the same across the area. Because MRSA Northeast is one service area, a contract covers members from Longview to Lufkin to Texarkana. Clients from Rains or Hopkins County carry the same plans as Smith County clients.
  • Weather. Severe thunderstorms, tornadoes and winter ice can close rural roads. Put them in your hazard vulnerability analysis and decide in advance when groups move online.

The local landscape

Earn referrals with quick assessments and honest updates. Paying or giving anything of value for referrals is illegal under the Texas Patient Solicitation Act and EKRA (patient brokering laws, explained). We never arrange referrals.

  • The Andrews Center Behavioral Healthcare System, based in Tyler, is the local mental health authority for Henderson, Rains, Smith, Van Zandt and Wood counties (HHSC: find your local mental health authority). HHSC's OSAR page lists it as the Region 4 OSAR provider, the program that screens people and links them to state-funded substance use treatment (HHSC OSAR page). Agree on crisis hand-offs, and decide whether you'll take state-funded clients.
  • Hospitals. Tyler's regional hospital systems draw patients from across East Texas and discharge some who need a step down. Case managers want your levels of care, accepted plans and how fast you assess.
  • Courts and probation. If the county runs a drug court or other specialty court under Government Code chapter 123, reports go only with the client's consent under 42 CFR Part 2.
  • Rural clinics and counselors across the region refer clients who need more structure than weekly therapy. A one-page sheet with your schedule, telehealth options and accepted plans does more than lunches. Legal marketing is in how to market a treatment center.
