How to start an IOP or PHP in Victoria
Victoria is the hub of the Crossroads, the stretch of the coastal plain between Houston, San Antonio and Corpus Christi. Its Medicaid plans are Corpus Christi's, its state OSAR region is San Antonio's, and three of the seven counties its mental health authority serves sit in yet another Medicaid service area. Here's how to sort that out when opening a substance use intensive outpatient or partial hospitalization program, from operators who run a licensed Texas PHP, IOP and outpatient program.
Updated October 27, 2026. Not legal advice. Cima Consulting isn't a law or accounting firm; confirm building rules with the city and plan line-ups with HHSC before you rely on them.
The short answer: a Victoria SUD program needs HHSC's chemical dependency treatment facility license, like any Texas program. The City of Victoria's Development Services won't let you occupy the space, release utilities in your name or open until the final building, electrical, mechanical, plumbing, public works and fire inspections (and health, where it applies) are approved. Victoria County is in Texas Medicaid's Nueces service area, where HHSC lists Driscoll, Superior and UnitedHealthcare for STAR and Superior and Wellpoint for STAR+PLUS, so Superior is the one plan in both. Gulf Bend Center is the local mental health authority for Victoria and six neighboring counties.

The license is statewide
HHSC licenses Texas substance use programs as chemical dependency treatment facilities under Health and Safety Code chapter 464 and 26 TAC 564; Victoria adds no treatment license. As of October 2026 the fee under 26 TAC 564.408 is $1,200 plus $125 per additional site. A program that later wants an office in Port Lavaca, Cuero or Edna adds a licensed site each time, with its own building approvals and staffing. If services at a site stop for more than 60 days, as they can after a hurricane, HHSC retires that site's license unless you've asked for inactive status (26 TAC 564.406). The packet is in our CDTF license guide, the proof list in 26 TAC 564 in plain English, and the whole path in how to start an IOP or PHP in Texas.
Permits, final inspections and the certificate of occupancy
The City of Victoria's building guide lays out the end of the process plainly. Before a building can be occupied, utilities released in the owner's or tenant's name, or business conducted, these inspections must be approved:
| Final inspection | What to have ready |
|---|---|
| Building | All earlier corrections closed; exits, accessibility and the room uses on your plan |
| Electrical, mechanical, plumbing | Trade permits finaled by your contractors |
| Public works | Site, driveway and utility items the city flagged |
| Health | Only where it applies (food service, for example) |
| Fire marshal | Extinguishers, exit signs and lighting, alarm if required, occupant load posted for group rooms |
Once those pass, the certificate of occupancy can be picked up at Development Services or sent on request. The city's building plans page says plan review time varies with the building's size and occupancy type. If you're taking over a space with a valid certificate and changing only the name or tenant, Chapter 24 of the city code lists a smaller fee for a name or tenant occupancy change, with a higher amount when an inspection is included (Victoria fee code); a treatment program replacing a store or office is usually a change of use, which is reviewed more fully. A build-out estimated at $50,000 or more must also be registered with TDLR for accessibility review and inspection (TDLR). Ask Development Services in writing:
- Is an outpatient substance use treatment program allowed under the zoning at this address?
- Is our move-in a change of use or occupancy, and which permits will the build-out need?
- Is the site in a mapped floodplain, and does that change what we can build?
- What will the fire marshal check, given our group-room occupant load?
Lease with a contingency for the certificate of occupancy and the HHSC license; every site step is on our Texas IOP opening checklist.
Medicaid plans in the Nueces service area
After the HHSC license, enroll with TMHP, then credential with each plan. TMHP has said Medicaid SUD treatment may only be delivered in a licensed chemical dependency treatment facility (TMHP notice).
| Program | Who it covers | Plans in the Nueces service area |
|---|---|---|
| STAR | Most children, pregnant women and some families | Driscoll, Superior, UnitedHealthcare |
| STAR+PLUS | Adults with disabilities and adults 65 and older | Superior, Wellpoint |
| CHIP | Children in families above Medicaid income | Driscoll, Superior, UnitedHealthcare |
| STAR Kids | Children and young adults with disabilities | Driscoll, Superior |
- Superior first for adults. Superior is the only plan in both STAR and STAR+PLUS here, and its 2024 STAR+PLUS award notice confirms it kept the Nueces area (Superior). See our Superior HealthPlan guide.
- Then choose by client. Wellpoint adds STAR+PLUS adults (Wellpoint Texas guide); UnitedHealthcare adds STAR members (UnitedHealthcare and Optum). Driscoll Health Plan is in STAR, CHIP and STAR Kids here, so it matters most if you serve adolescents; see adolescent IOP in Texas.
- Ask about in-lieu-of services. Texas Medicaid plans may pay adult PHP and IOP as an in-lieu-of service; ask each plan whether it does. Our Texas Medicaid IOP and PHP guide explains.
The filing order is in our Texas Medicaid credentialing guide, every area is in Texas Medicaid health plans by service area, and our credentialing service files and follows each application.
Serving the Crossroads
Victoria draws clients from a ring of rural counties, and they don't all carry the same Medicaid plans. Check the county on every member's card at intake:
| Client lives in… | Medicaid service area | What it means |
|---|---|---|
| Victoria, Calhoun, Goliad, Refugio | Nueces | Your Nueces contracts cover them, and Gulf Bend Center is their local authority |
| DeWitt, Jackson, Lavaca | Not Nueces (a rural service area) | Gulf Bend serves them, but their plans come from a different line-up; check HHSC's map |
| Wharton, Matagorda | Harris | Houston-area plans; see our Houston guide |
- Schedule for the drive. Evening tracks and a transportation question at intake keep attendance up; see our IOP schedule templates.
- Telehealth within the rule. 26 TAC 564.911 allows counseling by electronic means with identity checks, consent for each service and limits on audio-only. Check each plan's coverage first; our virtual IOP guide covers the payer side.
Hurricanes and the Guadalupe
Hurricane Harvey's 2017 landfall left Victoria with downed trees and power lines, a boil-water order and a curfew, and then the Guadalupe River rose past major flood stage as upstream water arrived (Texas Public Radio). For a program that means:
- Check the flood map before you lease. Look up the address on FEMA's Flood Map Service Center and ask the landlord about past water.
- Write the closing rule now. Who decides to close, how clients hear, when groups move online and how a cancelled day is documented. Comply's emergency operations plan guide and hazard vulnerability analysis walk through both.
- Keep charts reachable. A cloud EHR keeps records and billing available when the building isn't; ours, Cima EHR for IOP and PHP, runs in the browser.
Hiring in Victoria
The local clinician pool is small, so start recruiting before you sign the lease. HHSC checks hiring practices under 26 TAC 564.601; the roles it expects are in IOP staffing requirements in Texas.
- Verify licenses at the source. LCDCs and counselor interns through HHSC's LCDC program; LPCs, LMFTs, LCSWs and psychologists through the Behavioral Health Executive Council; and every hire against the OIG exclusion list.
- University of Houston–Victoria offers a 60-credit M.S. in Clinical Mental Health Counseling, online, which it says is CACREP-accredited and designed to meet Texas LPC coursework requirements (UHV). The program was due to seek reaffirmation of its accreditation in 2026, so check CACREP's directory for the current status. Graduates need supervised hours; see hiring and supervising associates.
The local landscape
Earn referrals with quick assessments and honest updates. Paying or giving anything of value for referrals is illegal under the Texas Patient Solicitation Act and EKRA (patient brokering laws, explained). We never arrange referrals.
- Gulf Bend Center is the local mental health authority for Calhoun, DeWitt, Goliad, Jackson, Lavaca, Refugio and Victoria counties (HHSC LMHA directory). It has provided outpatient mental health and substance use treatment for more than 50 years and was identified as a Certified Community Behavioral Health Clinic in 2021 (Methodist Healthcare Ministries). Learn where your program fits next to its services and agree on crisis hand-offs.
- OSAR. Victoria is in HHSC Region 8, whose Outreach, Screening, Assessment and Referral program is run by The Center for Health Care Services in San Antonio; CARF's directory lists a Victoria OSAR location (HHSC OSAR page). Decide whether you'll take state-funded clients.
- Hospitals. Citizens Medical Center, a county hospital, and the two-hospital DeTar Healthcare System discharge patients who need a step down. Case managers want your levels of care, accepted plans and assessment times.
- Courts and probation. Specialty courts operate under Government Code chapter 123; reports go only with the client's written consent under 42 CFR Part 2. Legal outreach is in how to market a treatment center.
The order of work in Victoria
| Step | Victoria detail | Typical time in our roadmap |
|---|---|---|
| 1. Program model and budget | Levels of care, telehealth for outlying counties, which plans first. Run the break-even calculator. | 1–2 months |
| 2. Site search | Zoning, change of use and the flood map | about 30 days |
| 3. Lease with a contingency | Out if the certificate of occupancy or license fails; free rent for the build-out | about 3 weeks |
| 4. Build-out | Permits through Development Services; TDLR registration if $50,000 or more | about 6 weeks |
| 5. Final inspections and certificate of occupancy | Building, trades, public works, fire; then utilities in your name | about 3 weeks |
| 6. HHSC license and inspection | The statewide process | about 2–3 months |
| 7. Facility contracts | TMHP, then Superior, Wellpoint and UnitedHealthcare (Driscoll for adolescents), plus commercial plans | about 90 days each |
The times are planning figures from our own launch roadmap, not promises. On that roadmap the first admission comes about 6 months after kickoff. Costs are in how much it costs to start an IOP.

Questions
Which Medicaid plans serve Victoria?
Victoria County is in the Nueces service area. HHSC lists Driscoll, Superior and UnitedHealthcare for STAR and Superior and Wellpoint for STAR+PLUS, the same plans as Corpus Christi.
Who is the local mental health authority in Victoria?
Gulf Bend Center, for Calhoun, DeWitt, Goliad, Jackson, Lavaca, Refugio and Victoria counties. Region 8's OSAR is run by The Center for Health Care Services, with a Victoria location.
What inspections does Victoria require before I can open?
The final building, electrical, mechanical, plumbing, public works and fire marshal inspections, plus health where it applies. Until they pass, you can't occupy the space, get utilities released in your name or conduct business.
Do clients from Cuero or Edna use the same Medicaid plans?
Not necessarily. DeWitt, Jackson and Lavaca counties are outside the Nueces service area, so their members may carry different plans even though Gulf Bend Center serves them. Check the member's county and plan at every intake.
How long does it take to open an IOP in Victoria?
Plan on nine to twelve months to a full caseload of insured clients. Recruiting staff early matters as much as the paperwork, because the local clinician pool is small.
